Welcome to Tech Solutions Limited, New Zealand's own online trading community. These terms and conditions are intended to help keep Tech Solutions Limited a safe place to shop. 

 

Consumer Guarantees Act

If you are buying goods normally bought for personal, domestic or household use, you may have certain rights under the Consumer Guarantees Act 1993 (Consumer Guarantees Act) that cannot be excluded or limited. These terms do not limit or alter your rights under the Consumer Guarantees Act (other than in the circumstances permitted under that Act). You can find more information about your rights under the Consumer Guarantees Act at the Ministry of Business, Innovation & Employment's website (www.consumerprotection.govt.nz/general-help/consumer-laws/consumer-guarantees-act) and the Commerce Commission's website (comcom.govt.nz/consumers/your-rights-as-a-consumer)

The Consumer Guarantee Act will not apply for any goods purchased by a buyer for purposes of a business.

 

1.1 Acceptance of terms and conditions: 

The terms and conditions are the terms on which Tech Solutions Limited offers you access to the Services and the Website. By registering as a member of Tech Solutions Limited you accept these terms and conditions. If you do not accept these terms and conditions, you must refrain from using the Services. 

 

1.2 Amendment of terms and conditions: 

As Tech Solutions Limited operates in a changing commercial, technological and regulatory environment, we may amend these terms and conditions from time to time. We will communicate all changes by Site Announcement. Occasionally, we may make urgent changes, but will generally give you at least two weeks’ notice to review these changes. We may also seek your feedback on proposed changes on the Message Board, or, for significant changes notify you directly via email. Unless otherwise stated, amendments will be effective immediately upon posting of the amended terms and conditions on this Website. You are responsible for ensuring you are familiar with the latest terms and conditions. Your continued use of the Services represents your agreement to be bound by the terms and conditions as amended. 

 

1.3 Terminology: 

In these terms and conditions, the following expressions have the meanings set out:  'item', 'items' means goods that may be bought through the website of Tech Solutions Limited; 

'member' means a registered member of Tech Solutions Limited; 

'Services' means any one or more of the services offered by Tech Solutions Limited wholly owned subsidiaries, from time to time, including online products, classifieds, message boards, sms alerts and any other service that Tech Solutions Limited may offer; 

'we', 'us' and 'our' are a reference to Tech Solutions Limited; 

'you' and 'your' are a reference to you; 

'Website' means any Tech Solutions Limited website through which the services are offered; 

'listing' means a listing on the Website through which you buy any item, service or job; 

 

SPECIFIC WARNINGS

 

2.1 Disclaimer: 

You expressly understand and agree that: 

2.1.1. while Tech Solutions Limited may facilitate payment for some items by credit card, Tech Solutions Limited is in no way involved in the transaction itself.

2.1.2. while Tech Solutions Limited has systems in place to reduce the risk of credit card fraud, Tech Solutions Limited is not responsible for protecting members from credit card fraud. Tech Solutions Limited fraud protection systems may from time to time block legitimate credit card payments. In these cases payment will need to be made by other means.

 

2.2 Breach: 

Without limiting any other rights and remedies available to Tech Solutions Limited, Tech Solutions Limited may limit your activities on the Website, issue a warning to you, suspend or terminate your membership, or refuse to provide our Services to you if you breach these terms and conditions.

 

2.3 Additional rules: 

In addition to the terms and conditions set out in this document, Services Policy form part of these terms and conditions.

 

 

BECOMING A MEMBER 

 

3.1 Becoming a Member: 

Becoming a member is free. You may only register as a member if you are resident in New Zealand or Australia. You must be at least 18 years old. By registering as a member, you warrant that you can form a legally binding contract. 

 

 

3.2 Accurate Information: 

You warrant that you have provided complete, accurate and current personal information when registering as a member. You must maintain and update your personal information held by Tech Solutions Limited to ensure it is kept current at all times. Tech Solutions Limited may phone or mail you to verify these details. You must not register as a member under multiple identities or personas (whether false or not). However, at Tech Solutions Limited discretion, you may create a business membership in addition to your personal membership. 

 

3.3 Termination of membership: 

Tech Solutions Limited reserves the right to decline to register or to terminate your membership without entering into further discussions with you. When limiting your activities on the Website Tech Solutions Limited may consider offsite conduct such as prior criminal convictions, insolvency, or any other conduct that puts our community or systems at risk. In the event of termination, you also agree that you will not open or attempt to open any new Tech Solutions Limited memberships. You may at any time close your Tech Solutions Limited membership. If you close your membership, or if it is terminated by Tech Solutions Limited, your ability to use the Tech Solutions Limited website will end.

 

3.4 Security of your login information: 

You are responsible for keeping your login information, including your email address and password, secret and secure. Without limiting the foregoing, you agree: 

 

not to permit any other person to use your user name or membership; and 

not to disclose, or provide to any other person, your password, email address, date of birth or any other information in connection with your membership that may allow them to gain access to your membership.

 

3.5 Emails and newsletters: 

Tech Solutions Limited will send you emails relating to your membership, transactions and other activities on the Website, and for promoting and marketing other Tech Solutions Limited products and Services to you. Tech Solutions Limited may also send regular electronic newsletters to members. Newsletters will contain clear and obvious instructions for how you can unsubscribe from the mailing list. 

 

 

GENERAL RULES 

 

4.1 General

 

All communications made with Tech Solutions Limited shall be made in good faith. 

You must not damage, interfere with or harm the Website or Services, or any network, or system underlying or connected to them, or attempt to do so. 

You may not use a robot, spider, scraper or other unauthorised automated means to access the Website or information featured on it for any purpose. 

You are responsible for any actions taken through your membership. Tech Solutions Limited memberships are not transferable and therefore cannot be sold, leased, lent or traded without specific written authorisation from Tech Solutions Limited.

 

4.2 Your obligations as a buyer

 

You must be located in New Zealand or Australia to buy on Tech Solutions Limited. People outside of these countries are not permitted to purchase items on Tech Solutions Limited. 

You must make full and prompt payment for any item you buy. 

You must only access the if you are at least 18 years old. 

 

 

FEES AND ACCOUNTS 

 

5.1 Tech Solutions Limited Fees

 

Tech Solutions Limited reserves the right to change the fees charged for any of our Services or products at any time. In the event that we introduce a new or products, the fees for that Service or products are effective at the launch of the Service or products, unless otherwise stated. 

If you are a New Zealand resident, then all fees are inclusive of GST and in New Zealand dollars unless otherwise stated.

You must pay the fees immediately upon demand by Tech Solutions Limited.

 

5.2 Tech Solutions Limited Low Price Guarantee guidelines and limitations:

 

Price matching is only available for repair services listed on Tech Solutions Limited

The price in question must be published (either print or online) by a local retailer with a brick and mortar store front within 10 miles of the Tech Solutions Limited location

We reserve the right to verify the price of the identical, in-stock repair components at the retailer location (i.e., size, model, brand, colour, spec).

We do limit quantities to one-per-customer, per repair, per day

The repair price must be a regularly published price. Tech Solutions Limited Low Price Low Price Guarantee does not apply to competitor's specials, coupons or other discounts.

Once the work order is printed and signed the price is not subject to change.

 

 

5.3 Tech Solutions Limited Lowest Price Guarantee does not apply to:

 

Repair Prices from auctions or retailers requiring memberships

Prices from mobile repair providers, or any repair provider without a brick and mortar store front

Repair prices that are dependent on add-ons, other items, fees, or charges

Bundle offers, instant rebates, mail-in offers, or offers that include financing

Prices that require minimum purchases amount or quantity

Repair prices that other retailers have listed as clearance, close out, liquidation, special hour/flash/limited quantity offers

Repair prices that utilize damaged, OEM or used components

Misprinted or inaccurate prices.

 

5.4 Products damaged in transit: If your product has been damaged during transit to your delivery address we will replace your product (if it is available) or issue a credit / refund. In these circumstances, if the Consumer Guarantees Act applies to the purchase, we will meet our obligations under that Act. Otherwise, if the Consumer Guarantees Act does not apply, unless we agree otherwise, you must notify us within 24 hours of delivery in order to be eligible for a replacement, credit or refund

 

5.5 Restocking fees: In some special circumstances including when products are sold to Business customers, we may agree (at our discretion) to accept a return of a product that is not faulty. In these situations there will be a handling fee equal to at least 15% of the goods value. Delivery, service and assembly fees are not refunded at all.

 

5.6 Changing your mind / purchasing the wrong product by mistake: If you change your mind after making a purchase, or realise you have purchased the incorrect item, you can enjoy the peace of mind that we offer a 7 day exchange policy excludes specials or clearance products. If there is not a suitable product that can be exchanged for your returned item you will be offered a credit on your account or store card based on the value paid at the time of purchase. Items purchased on finance cannot be exchanged for a gift card. To exchange a product, goods must be sealed / unopened, with packaging in original condition, and we will need to be notified within 7 days of purchase / delivery.

 

5.7 WARRANTY

5.7.1 Do not seek to organize repair of the equipment yourself. A warranty claim will only be accepted if authorized by Tech Solutions Limited prior to the commencement of service.

5.7.2 Please contact Tech Solutions Limited by phone 0508050505 or email service@techsolutionsltd.co.nz and report the fault. The Model No., Serial No. and a description of the problem must be supplied.

5.7.3 Tech Solutions Limited will advise whether the claim is accepted and covered under warranty. For warranty repair, please ship your product to us or to the advised nearest authorised service agent. Considered “built in” equipment will be repaired on site, if possible. The work to be carried out will be given by Tech Solutions Limited to the service agent.

5.7.4 Tech Solutions Limited will endeavour to deal with claims urgently, but does not guarantee that any service to be performed under this warranty will be carried out within any particular time limit.

 

5.7.5 Parts Enquiries and Purchases:  All sales are final, and will not be accepted for returns or refund as a result of incorrect order from customer. A voucher of same value can be issued instead. If received parts/products are found faulty within 7 days from the day of purchase such parts/products will be replaced. After 7 days from the day of purchase if such parts/products are found faulty they will be tested and depending upon test results it we be repaired or replaced as necessary. A standard fee of $25.00+gst apply if no fault is found. All parts and accessories carry a 14 days warranty from the date of purchase unless specified. Tech Solutions Ltd Terms of Trade apply to both spare parts, products and accessory sales. All parts sold should be installed by a professional having a proven experience of minimum 18 months in an registered organisation.

 

5.7.6 Under the 14 days right of exchange policy, you can return any product for an exchange or store gift voucher within 14 days from the date of purchase. This is on the condition, when the product is returned in its original condition with tags attached, boxes must still be sealed and the item unused with packaging and invoice.

 

5.7.7 We provide no warranty and exchange policy on software, unsealed products, Sim cards, recharge cards and vouchers.

 

 

 

5.8 SHIPPING

5.8.1 Tech Solutions Ltd utilises Payport Limited services to provide pick-up and return delivery services.

5.8.2  Insurance of goods in transit is the responsibility of the owner of the goods.

5.8.3  Goods are shipped within 72 hours once full payment is confirmed. Any delays or non-availability of parts or peripherals will be notified to you.

 

 

 

GENERAL PROVISIONS 

 

6.1 System Integrity: 

 

Tech Solutions Limited will use its reasonable endeavours to ensure the availability of the Website and Services, subject to any downtime required for maintenance. However, Tech Solutions Limited takes no responsibility for any system unavailability, or for any loss that is incurred as a result of Website or Services being unavailable. Further, Tech Solutions Limited assumes no responsibility for the corruption of any data or information held by Tech Solutions Limited. 

 

6.2 Force Majeure: 

 

Tech Solutions Limited has no liability for any lack of performance, unavailability or failure of the Services or the Website, or for any failure of Tech Solutions Limited to comply with these terms and conditions where the same arises from any cause reasonably beyond the control of Tech Solutions Limited. 

 

6.3 No Waiver: 

 

If we do not exercise or enforce any right available to us under these terms and conditions, it does not constitute a waiver of those rights. 

 

 

 

6.4 Partial Invalidity: 

 

If any provision of these terms and conditions becomes or is held to be invalid, unenforceable or illegal for any reason, and in any respect, that provision shall be severed from the remaining terms and conditions, which shall continue in full force and effect. 

 

 

 

 

6.5 Governing Law: 

 

These terms and conditions are governed by the laws of New Zealand. You submit to the non-exclusive jurisdiction of the Courts of New Zealand. 

 

6.6 Intellectual Property Rights: 

 

Tech Solutions Limited owns all proprietary and intellectual property rights in the Website and the software and other material underlying and forming part of the Services and the Website. 

 

You may not without our prior written permission, in any form or by any means:

Adapt, reproduce, copy, store, distribute, print, display, perform, publish or create derivative works from any part of this Website; or

Commercialise, copy, or on-sell any information, or items obtained from any part of this Website.

 

6.7 Entire agreement: 

 

These terms and conditions supersede all previous conditions, understandings, commitments, agreements and representations whatsoever whether oral or written, and constitutes the entire agreement, between the parties, relating to the subject matter of these terms and conditions. 

 

6.10 Privacy: 

 

Tech Solutions Limited collects, uses and discloses personal information about you, as outlined in detail within our privacy policy.
